WHAT IS A PROTECTIVE ORDER?

A PROTECTIVE ORDER is a court order, issued by a judge, designed to protect one or more present or previous members of a family or household from harm by another member of a family or household.

WHERE TO OBTAIN A PROTECTIVE ORDER?

A PROTECIVE ORDER can be requested at the Bexar County District Attorney's Office - Family Justice and Victim Protection Division, located in the Bexar County Family Justice Center, Brady Green Clinic Building, 527 N. HOW TO OBTAIN A PROTECTIVE ORDER?

The applicant for a Protective Order will be interviewed regarding the offender's acts of family violence and a statement will be obtained from the applicant. The applicant should bring copies of any police reports and information on how to serve notice on the offending party.

A Court hearing will be set to determine if the Protective Order will be granted.

The District Attorney's Office does not charge a fee to issue a Protective Order and you do not need an attorney to obtain an Order.
However, a Protective Order may also be requested through a private attorney, and fees may be charged by the private attorney.

ENFORCING A PROTECTIVE ORDER

A PROTECTIVE ORDER prohibits the offending party from certain acts such as:
     Committing family violence,
     Going near the applicant's residence,
     Going near the applicant's place of employment.
The Protective Order will specifically list all the conditions which must be met. If there is a violation of the Protective Order, the protected party should call the police immediatly. The police can arrest the offender and file a criminal case (see Texas Penal Code 25.07).
