The Land Entitlements Section is responsible for the first step of developing your property. Whether residential or commercial, determining the status of your property is important before beginning the planning and development of your property. Staff can assist you in making an initial determination of whether or not a property is eligible for utility service or the issuance of building permits. What Are Entitlements?
• The right to develop land with government approvals that increase the underlying value of
the land to which they are applied.
• Entitlements may include land use designations, density or the addition of utility
installations, streets, or other physical infrastructure.
Where do entitlements fit in the development process?
• Zoning Approval (if inside city limits or City South Management Authority)
• Master Development Plan (MDP), as applicable
• Planned Unit Development (PUD) Plan, as applicable
• Fair Notice (optional)
• Subdivision Plat Approval
• Permitting and Building Plan Approval

The Division consists of two action teams to facilitate land development in the City of San Antonio and its extraterritorial jurisdiction (see the ETJ limits at

) Subdivision Team:
The subdivision action team administers the platting process which ensures that a project is on a legally subdivided lot that is of sufficient size to provide for buildings, easements and vehicular access. Specific subdivision considerations include the layout of the property, including the shape and size of the lot, as well as street layout, drainage and grading concerns. Utility service is also included in the subdivision process, including the extension of electric, water and wastewater lines into a site.
Subdivision types:
• Major Plat – five (5) or more lots; 50 day technical review
• Minor Plat – four (4) lots or less without infrastructure; 10 day technical review
• Amending Plat – to correct an error on a previously approved or recorded plat
• Replats – area previously platted with proposal to reconfigure lots or further subdivision
MDP Team:
The MDP team administers pre-development entitlements for large or complex projects including Master Development Plans, Planned Unit Developments and Rights Determinations.
A Master Development Plan (MDP) is required for any development of two or more phases. Upon approval, a MDP establishes an agreement between the City and the applicant on the general layout of the site. This agreement includes the location and widths of proposed streets, lots, blocks, floodplains and easements. In many cases it may also indicate the location of future community facilities such as schools and parks. MDPs were formerly known as preliminary overall development plans (POADPs).
Planned Unit Development (PUD) Plans are required for sites with PUD zoning. A PUD plan is a highly detailed plan for a site that indicates land uses, street layout and dimensions, conservation and open space areas.
A Rights Determination is an optional process that an applicant may request for recognition of previously acquired entitlements for a particular parcel or lot. Rights determinations were formerly know as vested rights permits (VRP).
Fair Notice Form (FNF) is required with any application for a permit by which an applicant desired to accrue rights under Chapter 245 including a category Determination from SAWS or an application for Plat ID/Letter of Certification. A permit application must be filed within 45 days of fair notice.
