PUBLIC NOTICE FOR MAJESTIC RANCH APARTMENTS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of San Antonio.

REQUEST FOR RELEASE OF FUNDS
On or after September 9, 2019, the City of San Antonio will submit a request to the United States Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds to undertake the following project:

Project Title: Majestic Ranch Apartments

Location: 4862 Callaghan Rd. (East Village) and 118 Woodside (West Village), San Antonio, Texas 78228

Project Description: Hogan Properties Company, Inc. is proposing to utilize CDBG funds to acquire property to develop a newly constructed 288 unit affordable multi-family housing development, called the "Majestic Ranch Apartments", at 4862 Callaghan Rd. (East Village) and 118 Woodside (West Village), San Antonio, Bexar County, Texas 78228 in Council District 7. All of the units would be leased to low-income households whose income is at or below 60 percent of the area median income. The purpose of the proposed project is to provide affordable housing opportunities for low-income residents. The project would include the following: acquisition of properties; construction of 15 three-story apartment buildings; construction of parking areas; construction of recreational facilities; construction of a 6-foot bridge over Zarzamora Creek to connect the western and eastern portions of the development. The West Village would encompass approximately 3.5 acres and would include four apartment buildings and 84 units (Buildings 12-15); this portion of the development would be accessible from Woodside Drive. The East Village would encompass approximately 9.6 acres and would include 11 apartment buildings and 204 units (1-11) and recreational facilities; the East Village would be accessible from Callaghan Road. CDBG funds would be used for acquisition of the property.

Mitigation Measures/Conditions/Permits (if any):
The following mitigation measures and conditions are required for the proposed project:
  1. The proposed development must consider special design considerations, as applicable, for building footings, foundation walls, and concrete slabs due to the proposed project’s location in areas where expansive soils exist.

  2. Hogan Properties Company, Inc. would include the necessary energy saving measures to comply with the City’s 2018 International Energy Conservation Codes (IECC), as well as the U.S. Department of Housing and Urban Development’s (HUD) Minimum Property Standards.

  3. The proposed project is located within the boundaries of the City of San Antonio’s Phase I Municipal Separate Storm Sewer System (MS4) and would comply with the applicable MS4 requirements.

  4. Hogan Properties Company, Inc. would comply with the Texas Commission on Environmental Quality’s (TCEQ) Texas Pollution Discharge Elimination System’s (TPDES) Construction General Permit (CGP). A Stormwater Pollution Prevention Plan (SW3P) would be prepared and implemented, and a construction site notice would be posted on the construction site. A Notice of Intent (NOI) would be required.

Estimated Project Cost: Total project costs are anticipated to be $43.9 million dollars. The total estimated CDBG cost is $1,250,000.
FINDING OF NO SIGNIFICANT IMPACT
The City of San Antonio has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City of San Antonio Neighborhood and Housing Services Department, Division of Grants Monitoring & Administration, 1400 South Flores, San Antonio, TX 78204, and may be examined or copied weekdays 8:00 A.M. to 4:00 P.M. It is also available online at https://www.sanantonio.gov/GMA/Notices.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the ERR may submit written comments to the City of San Antonio, Neighborhood and Housing Services Department, Division of Grants Monitoring & Administration, 1400 S. Flores Street, San Antonio, Texas 78204 or by e-mail to communitydevelopment@sanantonio.gov. All comments received by September 6, 2019 will be considered by the City of San Antonio prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of San Antonio certifies to HUD that Laura Salinas-Martinez, in her capacity as Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of San Antonio to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of San Antonio’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of San Antonio; (b) the City of San Antonio has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD Office of Community Planning and Development at 615 East Houston Street, San Antonio, Texas 78205-2001. Potential objectors should contact HUD to verify the actual last day of the objection period.
